Is No Child Left Behind out of step with English learners? Civil rights attorney Mary Hernandez recently gave an eye-opening presentation to the Education Committee of the State Assembly on this issue. The law firm of which Mary Hernandez is a partner is representing nine California school districts in the case of Coachella v. the State of California over the option in NCLB to allow testing of English learners for up to five years in their primary language. California has not allowed its school districts to exercise that option, and nine districts, not including LAUSD, are suing the state. UTLA has filed an amicus brief in support of the plaintiffs.
